Terms of sale and use

These terms apply to the use of the mazaaal.com website and of the Mazaaal application, published by Mordehai LTDA (see the legal notice). By creating an account or subscribing, you accept them.

The service

Mazaaal is a digital service for studying Judaism: a path of lessons, sourced study cards, exercises and spaced review. The content is educational; it does not constitute personal religious guidance, and differences in practice are flagged rather than settled.

Account

Creating an account requires a valid email address and a nickname. It can be done either on the website or in the application. You are responsible for access to your mailbox, which is what signs you in: we store no password, and it is a code or a link received by email that identifies you. An account is personal; sharing it is not allowed.

Free tier and subscription

• Free: the first lessons of the path and a selection of content are available without payment, with an account.
• Subscription: it unlocks the whole path and the full measurement of your progress. The plans and the prices, inclusive of all taxes, are shown before any payment on the purchase screen.

Where you pay, and who collects

The subscription is bought through two channels, depending on where you subscribe. The service is the same; the handling of payment is not.

• On the mazaaal.com website: the seller is Mordehai LTDA. Payment is handled by Stripe.
• In the iOS application: the seller is Axel Mardoche Berdugo, an individual established in France. The subscription is an in-app purchase, collected by Apple under the App Store terms. Apple charges, invoices and refunds.

The service, its content and its price are identical in both cases. Only the identity of the seller changes, and with it the law applicable to the contract (see below).

In the iOS application, the subscription is taken only through in-app purchase: we offer no other payment method there, and the web channel is mentioned here only because one account may have subscribed on either side, under different cancellation rules.

Renewal and cancellation

In both cases, the subscription renews automatically at the end of each period of the plan you chose, and you may cancel at any time. Cancellation takes effect at the end of the period already paid for, which stays available until its term. Where you cancel, however, is not the same, and it matters: a subscription taken out in the application cannot be cancelled from the website, nor the other way round.

• Subscription taken out on the website: from the Account page (billing portal).
• Subscription taken out in the iOS application: from your device settings (Settings, your name, Subscriptions). Apple does not allow an in-app purchase to be cancelled anywhere else. Deleting the application cancels nothing.

Reminder before renewal. For a yearly plan, you are notified before the renewal date, in time to decide not to renew. For a subscription taken out in the iOS application, this reminder is sent by Apple. For a subscription taken out on the website, we send it by email, at the latest one month before the term.

If you subscribe while a subscription is already active through the other channel, we block the second purchase rather than let you pay twice. If a double payment happens anyway, write to us: we will sort it out.

Refunds

A refund request is handled where the money was collected. For a subscription taken out on the website, write to us. For an iOS in-app purchase, refunds are Apple's: the request goes to Apple, and we have no control over it. We can help you through the process.

Right of withdrawal

If you live in the European Union, you have a 14-day withdrawal period for a distance purchase.

The subscription gives you access immediately: by subscribing, you ask for the service to start right away. We do not use that request to deprive you of your right. You keep your 14 days. Write to us within that period and we refund the unused part of the current period, pro rata to the days elapsed; the account then returns to the free tier.

For an iOS in-app purchase, Apple is the one collecting payment: the refund request goes to Apple, under the App Store terms. Write to us all the same, and we will help you through it.

Prices and changes

Prices may change. A price change never applies to a period already paid for: it takes effect, at the earliest, at the next renewal, and you remain free to cancel beforehand.

Availability and changes to the service

We do what is needed for the service to be available and backed up, without being able to guarantee uninterrupted availability (maintenance, outages, force majeure). The content of the path evolves and grows; the structure of the lessons may change without this amounting to a change of contract.

Liability

The service is provided in good faith and its content is reviewed and sourced; an error always remains possible and can be reported to contact@mazaaal.com. The publisher cannot be held liable for the use made of the educational content nor for personal decisions taken on its basis: for your practice, consult your rabbi.

Governing law

The governing law follows the identity of the seller, and therefore the channel through which you subscribed.

• Subscription taken out on the website (seller: Mordehai LTDA): Brazilian law.
• Subscription taken out in the iOS application (seller: Axel Mardoche Berdugo): French law.

In both cases, if you live in the European Union, this choice does not deprive you of any of the mandatory protections of your country of residence. Any complaint may be sent to contact@mazaaal.com before any legal action; we look for an amicable solution first.
